ACO Canada Privacy Notice
Scope
This Privacy Notice applies to information, including personal information, collected about you by ACO.
We collect information about you from a variety of sources, including:
Information we collect from you directly.
Information we collect about you when you visit our site, use our services, or view our online advertisements.
Information we collect about you from other sources, such as commercially available sources.
All the information we collect about you may be combined to help us tailor our communications to you and to develop world-class products and services.
Uses / Information Sharing
We use the information we collect to provide the products and services you request, to tell you about other products and services offered by ACO, and to manage our sites and services. We do not share your personal information with third-party marketers, unless we have asked for and obtained your explicit consent.
We may share your information with our third-party service suppliers, including those who work on behalf of ACO and our business partners to send you joint communications that we hope you find of interest. If a ACO brand is sold to another company, to protect and defend the right and property of ACO (including enforcing our Terms and Conditions) when required by law, and / or public authorities, we give you choices about how we communicate with you.
Completing the Consultation Request Form/Sending materials
On our website, you can use a form to request a consultation and/or access to materials or planning tools. To send them to you or to contact you about a follow-up consultation, we need to know certain personal information about you (at least your e-mail address).
In addition, you can give us your consent to the processing of your personal information for the purpose of sending you information regarding our products and services (or our business partners’), news about our company, events we organize or participate in, etc. For this purpose, we would process the information that you have filled in before submitting the form. If you provide us with information about your job title and the organisation you work for or represent, we can evaluate which offers will be of interest to you and send you only relevant ones (for example, we send information relevant to architects for architects, restaurant owners for restaurant owners, etc.). You can withdraw your consent at any time. You can do this by using the unsubscribe link for marketing communications included in each email, by sending your request to: info@acocan.ca, or by sending your request by regular mail.
To verify that your interest in our offers and/or information about our activities continues, we will send you a reactivation e-mail 2 years after we have received your consent. This e-mail contains a link for you to click on in case your interest in our offers and information about our activities continues. If you do not confirm your interest, we will send you this e-mail again. In case of continued passivity, we will delete you from our database of recipients of such communications.
As part of the processing of your request for a follow-up consultation and/or materials or access to planning tools, we might store additional personal information in addition to the information you have filled in, if they are necessary for us to be able to prove that you have sent us your request and/or given a personal information processing consent. These may include storing your full IP address at the time of confirmation.

We inform you that we intend to transfer your personal information outside of Canada. We ensure a comparable level of protection for personal information in line with Personal Information Protection and Electronic Documents Act (S.C. 2000, c. 5) (hereinafter referred to as “PIPEDA”), including through appropriate contractual safeguards.
We use the services of ActiveCampaign LLC, a U.S.-based provider of marketing automation tools, to help us manage and analyse our marketing campaigns. As a result, your personal information may be transferred to and processed in the United States. While your information is outside Canada, it may be subject to the laws of the foreign jurisdiction, including lawful access by U.S. authorities.
In addition, your personal information may also be transferred to and processed in the Czech Republic for the purposes of administrative operations. The recipient in the Czech Republic acts as a data processor under the EU General Data Protection Regulation (hereinafter referred to as “GDPR”), and our relationship is governed by a data processing agreement in compliance with Article 28 GDPR.
We remain responsible for the protection of your personal information and ensure, through contractual or other safeguards, that other recipients provide a level of protection that is comparable to that required under Canadian privacy law (PIPEDA).
